1. General

1.1 The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as β€œyou” or the β€œCustomer”) with SN ECOMMERCE LLP with registered address in 128 City Road, London, United Kingdom, EC1V 2NX, (hereinafter referred to as β€œSN Ecommerce”, "us" orΒ  β€œwe” and together with the Customer, collectively the β€œParties”), at the SN Ecommerce’s website, mobile website, or mobile application, or via telephone (jointly referred to as β€œthekiddospace.co.uk”).

1.2 By using thekiddospace.co.uk and/or placing an order, you agree to be bound by the terms and conditions set out herein (hereinafter referred as to the β€œTerms”). Please make sure you have read and understood the Terms before placing your order.

1.3 Only persons 18 years or older, who are not under guardianship and, are not acting in a capacity of a company can place an order.

1.4 The inclusion of any products or services on thekiddospace.co.uk at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

1.5 We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on thekiddospace.co.uk at the time you place your order.

1.6 SN ECOMMERCE want to provide the best possible online experience. To make this possible we need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the thekiddospace.co.uk site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site to any user who violates this provision or any other provision in these terms and conditions.

2. Prices and delivery charges

2.1 The prices displayed at thekiddospace.co.uk include the statutory Value Added Tax but do not include a delivery charge.

2.2 There will be no delivery charge for each order regardless of the size or weight of your order. Notwithstanding the foregoing, we reserve the right to charge you delivery fees undert certain circumstances based on the purchased items which shall be indicated during the checkout prior to purchasing the item. If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries.Β 

3. Ordering/conclusion of contract

3.1 The ordering options available to you are via thekiddospace.co.uk or telephone. Please visit our Customer Service pages for further information.

3.2 Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, an SN ECOMMERCE representative will contact you to settle the refund.

4. Delivery

4.1 SN ECOMMERCE exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order to any address in the world.

4.2 SN ECOMMERCE endeavours to dispatch orders in the fastest possible time and in the order in which they are placed. We aim to deliver within 5 to 15 business days following confirmation of an order, unless otherwise agreed. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. In the unlikely event the delivery time exceeds 30 days, you may cancel your order.

4.3 Before you place your order, you will be informed of the expected delivery details. Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation with your expected delivery details.

4.4 If your order does not arrive by the scheduled date, please contact Customer Service.

4.5 We start processing your order quickly which means we cannot make any changes once it is confirmed, including changing the delivery address or delivery option. However, you may be able to update some details or redirect your parcel with the courier directly. If you do need to cancel your order, you must contact Customer Service by email. Notwithstanding the foregoing, if we have already shipped the order, you may not cancel your order as processing has begun and you are entitled to seek a refund and/or a replacement under section 5 and section 6.

5. Withdrawal of Order

5.1 You may seek a refund or replace your defective item from the date you place you receive the order until 30 days after receipt of the ordered items. If you have been charged for the items, you will receive a refund which will include SN ECOMMERCE's standard delivery costs. Should you choose to keep certain items and only partially cancel your order, the delivery cost will not be refunded.

5.2 If you wish to cancel your order, please provide us with notice in writing either by email; or contact Customer Service; us as set out in section 6 (Refunds) below within the 30-day period set forth in section 5.1 above. We will provide a refund attempting to use the same method used to make the payment as soon as possible and at the latest within 14 days of receiving your notice of cancellation, provided we have received the items or evidence of you having sent back the items. Another payment method may be used for the refund, provided that you consent to such change; in any case this will not generate any additional charges.

5.3 If the item you have received is defective, please notify SN ECOMMERCE promptly by providing us with pictures and/or videos of such defects and SN ECOMMERCE will, for any products deemed defective, provide a full refund or send you a new item based on the requirements you indicate to our Customer Service in accordance with section 6 (Refunds) below. The provisions set forth herein do not limit any applicable statutory rights.

6. Refunds

6.1 SN ECOMMERCE guarantees a full refund of the items and/or replace the faulty item in accordance with section 5 (Withdrawal of Order), provided that all items are products deemed defective. In such regard, in order to get a full refund, you must provide us with proof of such defects by sending an email to our email address info@thekiddospace.com.

6.3 We guarantee that faulty items, after our thorough checks, if eligible, will be either refunded or replaced with a new item sent to you and we will bear all delivery charges in light of those faulty items. Please note that incorrect orders without proof (e.g. wrong or missing items), cannot be refunded, replaced or handled by SN ECOMMERCE and will not be refunded.

6.4 The right of withdrawal and refund does not apply to goods which are liable to deteriorate or expire rapidly, for example, perishable products such as fresh cut flowers and plants.

7. Payment methods

7.1 You can pay for your goods in various ways as set out below.

  • Payment before delivery
  • Credit card or debit card
  • You can enter your payment details at the time you place your order using a valid credit or debit card (VISA, Mastercard, Apple Pay or American Express). The applicable amount will immediately be reserved on your card and debited. SN ECOMMERCE reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks.

  • When paying by PayPal, SN ECOMMERCE reserves the right to check the validity of the PayPal account, that there are enough funds to cover the purchase sum and validate the billing address details of the purchaser. The applicable amount will immediately be reserved on your PayPal account and debited. SN ECOMMERCE reserves the right to deny any purchase.

7.2 Our Pay later services are provided by Klarna.

7.3 As soon as your order has been dispatched in the warehouse, you will receive information from Klarna on how and when to complete your payment.

7.5 We reserve the right to make new payment methods available and or change the aforesaid payment methods as the case may be.

7.6 You will receive the legally required invoice document in the Shipping Confirmation e-mail.

8. Our Liability

8.1 Nothing in these Terms shall exclude or limit SN ECOMMERCE's liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
8.2 SN ECOMMERCE accepts liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.
8.3 SN ECOMMERCE is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
8.4 Our maximum liability to you for any loss or damage arising in connection with your order on thekiddospace.co.uk shall be limited to the total price of your order.
8.5 The ODR platform offers consumers and professionals within the European Union the possibility to reach an out-of-court solution for complaints related to online purchases. The one-stop website is designed to be interactive and easy to understand, available in all official European Union languages and free of charge. 9. Colours and measurements

9.1 We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.

9.2 An item’s measurements given on thekiddospace.co.uk are only approximate values to give you a better understanding of the model or fit of that specific item, and not a definite guarantee of the actual measurements of the item you receive. The final measurements of an item may vary depending on the material used in its production.

10. Guarantee

10.1 If there are defects in the goods you have purchased, SN ECOMMERCE abides by all statutory guaranteed regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know and we will endavour to give you a full refund or a new item.

11. Assignment

11.1 SN ECOMMERCE reserves the right to assign or pledge to third parties any claim(s) for payment including any payment instalments which have arisen in connection with the delivery of goods.

12. Severance

12.1 If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

13. Ownership of rights

13.1 All intellectual property rights, such as trademarks and copyrights at thekiddospace.co.uk remain with SN ECOMMERCE and its subsidiaries or licensors. Any use of thekiddospace.co.uk or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of SN ECOMMERCE.

14. Notice

14.1 All notices, requests, demands or other communications required or permitted by the terms of this Agreement will be given in writing and delivered to the Company at the following address:

15. Titles/Headings

15.1 Headings are inserted for the convenience of the parties only and are not to be considered when interpreting this Agreement.

16. Gender

16.1 Words in the singular mean and include the plural and vice versa. Words in the masculine mean and include the feminine and vice versa.

17. Governing Law and Jurisdiction

17.1 This Agreement will be governed by and construed in accordance with the laws of Italy. The Parties to this Agreement irrevocably agree that the court of Rome shall have exclusive jurisdiction to settle any dispute which may arise out of or in connection with this Agreement and that accordingly any Proceedings may be brought in such courts.

19. Force Majeure

19.1 A party shall not be considered to be in default or breach of this Agreement, and shall be excused from performance or liability for damages, as a result of any delay, failure in performance, or interruption of service resulting directly or indirectly from acts of God, network failures, acts of civil or military authorities, civil disturbances, wars, terrorism, energy crises, fires, transportation contingencies, interruptions in third party telecommunications or Internet equipment or service, other catastrophes, or any other occurrences which are beyond such party’s reasonable control.

20. Miscellaneous

20.1 If you are a consumer, nothing in this Agreement shall deprive you of the protection granted by the provisions of your consumer laws which are mandatory (in particular those defining consumer rights). In respect of any and all disputes with consumers, the mandatory rules on jurisdiction and applicable law shall apply. The court of the place or residence or domicile of the consumer shall have jurisdiction for any claim concerning consumers.

Pursuant to Articles 1341 and 1342 of the Italian Civil Code, You and Maestro specifically accept the following articles based on a serious, individual, and effective negotiation between you and SN ECOMMERCE LLP:
